Orphan Works Bill 2008 PASSED

Everyone remember the up roar DA was in near the beginning of the year? Remember how many people were stating that it was old news and that people were blowing things out of proportion?

Because the fires were put out most people most people missed when the bills were written and submitted. I admit that when the news originally came out there was people who were ill informed and were debating on old information from 2006. However, the issue was brought up with the effect to keep us aware of what was being proposed in 2008. On April 24 2008 (just after the community calmed down) the proposed bill was publish for both the Senate S.2913 and Congress H.R.5889.

The bill didn't just slip by the community it slipped by the Senate as well:

"On the evening of Friday September 26th, S. 2913 was passed by the U.S. Senate by unanimous consent, i.e. not a single Senator objected to the legislation."

Not a single Senator objected? The reason behind this is what the bill passed the US Senate by what is called "hotlining."

"In order for a bill to be hotlined, the Senate Majority Leader and Minority Leader must agree to pass it by unanimous consent, without a roll-call vote. The two leaders then inform Members of this agreement using special hotlines installed in each office and give Members a specified amount of time to object — in some cases as little as 15 minutes. If no objection is registered, the bill is passed."

Basically the bill passed with no roll call and not a guarantee that even half of the Senate had even read the bill.

I will not post my opinion here about anything just yet. I am merely trying to bring in an awareness and provide as much information as I stumble upon. I personally have not fully read the bill as of yet and do not know the difference in content from the 2006 version, but be aware that now the bill is in Congress and if it passes there the is only one last step before it passes as an official bill.

This is certainly not time to panic and just go by the rumor mill. Please inform yourself well and read the bills. If you disagree with the bill there are ways to stop it. The Illustrator's guild offers a way to do it for you (by clicking here: [link] ) but you don't have to use their method and can contact your own Congressman.

P.S. The title is just to catch people's attention. The bill has not yet fully passed by US standards. Remember that a bill must first pass through the Senate, then Congress, and finally the President before becoming official.

Crack Weekend Atalanta 08

Ok so Anime Weekend Atlanta turned out to be Crack Weekend Atalanta 2008 if only for Saturday night.

Basically it went like this:
Friday I don't really remember except that Ranko and I set up and were fighting with the crates from hell. We did have =s-girl's commission from *Ecthelian of her favorite pairing from Macross Frontier (that we make fun of her for) hostage. We also re-drew it for her but it was under appreciated (our left hands are offended).

Saturday Somewhere between 8:30am to 7:00pm =s-girl, ~Ninja-Ranko and I were sending supercilious notes to ~lc3 and his minion (I think we're going to get banned from Catdrool.com now XD). At the same time ~Kuritora was acting as a very lovely french cat-boy? maid. I'll be sure to print wallets and posters of this event. When the dealer's room closed we smuggled in *Ecthelian and *SheCow between =s-girl and I. Behind us =Tirael had shoved =yanimator behind her table with ~Kuritora and =luciole... basically we had too many people for the potential for ADD and to be McGuyver within a small enclosed space.

It all started with this drawing of gratitude from *Ecthelian :


Notice the portion in red that started a conversation of how I would inappropriately touch molest Grimmjow. I causally spoke that I would certainly want to rub his rump and chest but was perturbed about not being able to do both unless I was standing behind him and then shoved my hand through his hole and stroke his chest. Thus the insanity began. =s-girl deemed that it was both perverted, mortifying, and erotic and questioned to what Grimmjow's reaction would be. She also suggested to *Ecthelian to create a comic on this idea of using Grimmjow's hole (forever to be known as the Grimhole) as a sort of molesting love hole. Leading to this picture:



And since I felt that we hadn't drug this idea into the dirt enough... I drew this in response:



Behind us =yanimator and =Tirael were busy creating their own masterpiece that caused my eyes to bleed.

Sunday Was I awake? I don't really remember anything that happened in the morning except that no one in the surrounding tables was awake and kept talking about finding Hot Guys... or was it Hot Dogs? >__>;; Maybe Hot Coffee?

Overall I think I enjoyed myself the most at this AA over the previous ones. I was however pretty disappointed in the dealer's room, too many things that I wanted had their prices jacked up and then went even higher on Sunday wtf? Anyway certainly a great con that I truly adore.

DA Pop Culture = Crap 2.5

All About Me

I wanted to come back in here for a bit and restate something: This is good for DA. Granted this new favoriting system is currently like trying to navigate through white water rapids, it is much better than the old system we had prior. Again, this is a good direction for DA although admittedly a bumpy one.

In reading up more on how the actual system works, “Fair Exposure” is more catered to the underdog categories. There is also some sort of working in of comments and views that makes no sense to me but factor into the overall ' popularity ' of a piece. Regardless, I have come to the understanding that Anime Art is being discriminated in a sense. That's not fair either, I’ll admit that.

What is actually quite ironic is the idea that the old system had a sort of “democratic” vote theory to it. I find that this system actually represents that idea better by brining in a ratio sort of issue. Just like states that have a larger population than lower populated areas their votes become a more weighted and equally as important. DA trying to apply the same concept here, that while no art is created equal, every artist is.

I realize that a large part of the community here is in Anime/Fanart (I mean that is where I am right?) and they feel that since they are larger they should have more impute, but this is DeviantART not DeviantANIME ART. What DA is trying to put back into place is the ART aspect of this site. A lot of what is in the popular is one conformist idea. Artists are supposed to break the boundaries that they live in and move beyond the limits that we are given so why when the challenge is issued do so many cower?

Another large problem lies in what we (the community) are going to do about it. So many people are whining/griping about it others are actually coming up with valuable suggestions. Still it looks like DA isn’t moving on this and frankly I can see why. They want to see what is really going to happen here. Will there be more problems with miss-categorization (Lord knows that is a mess)? Or is this going to propel a lot of artists to grow exponentially? Will artists that had left come back now that they too have a chance against the ever growing commercialism or are we going to lose the standards that people reach for? In either case, the situation is this: We are not to accept the idea of “ONE ART THOUGHT.”

When I had first complained about this was because the popular only promoted one idea instead of promoting a multitude of ideas. That is why I love this new system (even though the issues are starting to become apparent) because there is diversity and shows that an artist is limited only by their imagination.

I’m on the goal to grow so I plan to stick around at watch what happens.
